Judge won't delay lawsuit over gay marriage ban

Attorneys for the Thomas More Society say they're not displeased that a Cook County judge ruled against them in a gay marriage case.

Chicago-based Thomas More Society attorney Tom Brejcha says instead they're looking forward to briefings on their motion to dismiss the case. A Cook County judge on Wednesday denied the law firm's request to delay the case pending U.S. Supreme Court action on gay marriage.

The lawsuits were filed by the American Civil Liberties Union and New York-based Lambda Legal. They are seeking legal gay marriage in Illinois. Lambda Legal says it's pleased the case will move forward. The ACLU called the delay request "a distraction."

The suit represents 25 couples who were denied marriage licenses in Cook County.
