Jeff Flake says he won't support final confirmation until after an FBI investigation. We discuss the latest with NBC senior politics editor Beth Fouhy. Also, the U.S. Securities and Exchange Commission sued Elon Musk on Thursday, alleging the CEO of Tesla committed securities fraud when he tweeted about taking the company private at $420 per share last month.
