Federal prosecutors ask judge to deny Blagojevich a third trial

Federal prosecutors are making their case for why Rod Blagojevich should not be allowed a third trial.

In a lengthy filing, prosecutors said Blagojevich’s convictions were just and, just as importantly, they said the trial was done in a fair way.

After he was found guilty on several corruption charges earlier this year, Blagojevich’s defense attorneys filed a motion saying the former Illinois governor didn’t get a fair trial. They said there were problems with everything from jury selection to the judge himself.

In their new filing, prosecutors say jurors who had opinions about Blagojevich before the trial said they could remain impartial during it. And they said the judge gave the defense ample time to go over the evidence and listen to the secret recordings.

Blagojevich is scheduled to be sentenced in October.
