The U.S. Supreme Court Wednesday approved the transfer of Jose Padilla to Miami, where he will face terrorism charges.

Padilla’s a former gang member and converted Muslim from Chicago.

Authorities first detained him 3 and 1/2 years ago, saying he was part of an al-Qaida plot to set off a dirty bomb within the United States.

Since then, Padilla’s been held on a military brig without being charged and without access to the courts.

His lawyers were challenging his military detention when the government brought different charges in Miami.

Those allege that Padilla raised money and recruited soldiers for violent jihad outside the United States.

Two weeks ago, a lower court denied Padilla’s transfer to Florida and criticized the Bush administration’s use of different facts in different courts.

Wednesday’s Supreme Court ruling overturns that decision.

It’s considered a victory for the Bush administration.

But the high court will still review the constitutionality of Padilla’s military detention.
