Legal questions surround release of Guantanamo detainees

Over the weekend the U.S. agreed to release five senior Taliban figures in exchange for the release of Army Sgt. Bowe Bergdahl, who was captured by the Taliban in Afghanistan nearly five years ago. The prisoner exchange has set off a heated political debate about whether the president has the legal authority to oversee such an exchange without first consulting Congress. We’ll discuss the case with attorney Marc Falkoff. He’s an associate professor of law at Northern Illinois University who has represented numerous Guantanamo prisoners.
