An Illinois court has again sided with Chicago in a more-than-five year battle over the city’s food truck ordinance. Chicago prohibits mobile eateries from operating within 200 feet of brick and mortar restaurants — a rule the city, and the court, says fairly balances market competition. A unanimous decision by the Illinois appellate court this week is a blow to food truck owner Laura Pekarik, who says the law is detrimental to her mobile cupcake business. The appellate court says the city has a right to protect businesses that pay property taxes. Pekarik’s attorney says they’ll take the case to the supreme court.
