In recent years, there’s been an increase in lawsuits over alleged violations of Illinois’ biometric information privacy act. The state’s protections around the collection of biometric data, like fingerprints or facial recognition scans, are unique, according to attorney Justin Kay who says Illinois was the first state to put a law like this on the books in 2008. Kay says often lawsuits are not able to prove a company, such as Facebook or Google, is causing harm.
