An attorney for students charged in the death of a fraternity pledge at Northern Illinois University is asking a judge to throw out the case. David Bogenberger died from excessive alcohol consumption when he was pledging Pi Kappa Alpha fraternity. Attorneys for the members of the fraternity say the case should be dismissed because the Illinois hazing law is too vague.
