Jim DeRogatis received an anonymous sex tape in 2002. The tape is at the heart of this trial.
Kelly’s lawyers want to know more about how the reporter got the tape, and issued a subpoena. Cook County Circuit Judge Vincent Gaughan rejected arguments from Sun-Times lawyers that DeRogatis has reporter privilege.
The judge ordered the reporter to come to court today. DeRogatis did not show up.
Prosecutors are charging Kelly with 14 counts of child pornography. The R&B singer is pleading not guilty.
